Cross Complaint Filed by Immanuel Schools

Orange County, CA, September 11, 2020 –  

Immanuel Schools prayerfully sought counsel from educational and medical experts, our legal advisors, and members of our Immanuel community before opening for on-campus instruction on Thursday, August 13th. During these past four weeks of on-campus instruction, we have witnessed first hand the positive impact of having Christ-centered, relationally based, face to face instruction. Our families are regularly telling us how they are seeing improvements in their child’s academic motivation, while also watching their physical, emotional, and spiritual health improve. These are undisputed benefits as to why on-campus instruction is needed and desired by most parents for their children. As we have stated before, we believe this is a family choice and they should not be denied this choice by government mandates that overreach their constitutional rights.

Online learning has been going for a couple weeks in most districts throughout Fresno County. Through no one’s fault, it is clear there are many challenges including inadequate internet speeds, losing power due to outages, security of communication platforms to prevent hackers, and most importantly the burden this puts on parents to choose or balance work with the education of their children. These challenges are hindering students ability to receive the proper education they need and deserve. 

During these last four weeks, we unfortunately have experienced the oftentimes arbitrary and capricious actions of those who are opposed to our campus being open for instruction. To address these actions we have decided to file a cross complaint against Fresno County. We believe we must take this legal action to assure that we have the opportunity to put all of our arguments in front of the court. 

It should also be noted that as of today there have been no reported cases of COVID-19 amongst our students, families, faculty or staff. This is consistent with the results of the antibody testing performed by Dr. Paul Atmajian. Dr. Atmajian has stated “Based on my training, knowledge, and experience, re-opening a school in which the majority of families have already been exposed to Covid-19 is as safe as can be expected.”

We want to finish by saying thank you for all the prayers and support we have received from many people throughout our community, central valley, and state. We remain steadfast in our commitment to have on-campus learning for our students because we believe it is what is best for them.
